三.抵免與扣除的選擇權
納稅人可在 抵免(Credit) 和 列為扣除(Deduction) 之間擇一:
- 抵免:直接減少應繳稅額,通常稅務上較有利
- 扣除:作為列舉扣除項目的一部分,但僅限於選擇 itemized deduction 的情況

Form 1116 (Foreign Tax Credit) is an important document in the U.S. tax system that allows taxpayers to claim a Foreign Tax Credit (FTC). When a U.S. taxpayer earns income abroad and pays foreign income taxes, the IRS allows the use of Form 1116 to reduce their U.S. federal income tax liability, in order to avoid double taxation.
1. Purpose of Form 1116
Under U.S. tax law, U.S. citizens and tax residents are taxed on their worldwide income. This means that even income earned abroad must be reported to the IRS. However, if that foreign income has already been taxed in the country where it was earned, the taxpayer may be eligible for a Foreign Tax Credit to avoid being taxed twice on the same income. Form 1116 is the primary tool used to calculate this credit.
2. Who Needs to File Form 1116?
Most U.S. persons or resident aliens who have foreign income and have paid foreign income taxes will need to complete this form. Common situations include:
- Earning dividends, interest, rental income, or capital gains from foreign investments
- Earning wages or business income from working or operating a business abroad
- Receiving rental income from foreign real estate
- Receiving dividends or other distributions from foreign corporations
- U.S. citizens living in places like Taiwan or Hong Kong who pay local income taxes
Note: If the total amount of foreign taxes paid during the year does not exceed $300 for single filers or $600 for joint filers, and other conditions are met, taxpayers may opt not to file Form 1116 and instead report the foreign tax credit directly on Form 1040.
3. Credit vs. Deduction: A Taxpayer's Choice
Taxpayers can choose between claiming a credit or taking a deduction for foreign taxes paid:
- Credit: Directly reduces the amount of tax owed and is generally more advantageous
- Deduction: Can only be used if the taxpayer chooses to itemize deductions, and reduces taxable income rather than the tax itself
