FinCEN Form 114 (FBAR):

Attention Unreported FBAR Holders! U.S. & Taiwan Discuss Enhanced Data Exchange; AI Enforcement Escalates
U.S. citizens holding accounts in Taiwan must be on high alert! The U.S. government is currently in talks with the Taiwan government to require further provision of detailed income and financial account information of U.S. tax residents in Taiwan. This signals that the transparency of cross-border assets is reaching an all-time high.
Two Enforcement Weapons: FATCA Upgrade + Artificial Intelligence In addition to the existing "FATCA" information exchange mechanism, the IRS has officially announced the deployment of Artificial Intelligence (AI) and big data analytics to scrutinize foreign account data. AI systems can rapidly cross-reference data reported by Taiwanese financial institutions with your U.S. tax returns to precisely target high-risk taxpayers who have underreported income or failed to file FBARs.
Delinquent FBARs Must Be Filed Immediately If the aggregate value of all your foreign financial accounts (including bank deposits, securities, cash value of life insurance, etc.) exceeded $10,000 at any time during the year, and you failed to file FinCEN Form 114 (FBAR):
- The Risk: Once identified by the AI system, you could face penalties for "non-willful" or severe "willful" violations (which can be as high as 50% of the account balance or more).
- The Solution: The only way to resolve this issue is to proactively file a Delinquent FBAR Submission or participate in the Streamlined Filing Compliance Procedures before the IRS initiates an examination.
USCPA Luo Xia reminds you that with the integration of AI in tax enforcement and deepening information exchange between the U.S. and Taiwan, there is no longer room to hide assets. If you have missed FBAR filings in the past, you must seize this final window of opportunity. Consult a qualified CPA to assist with remedial filings to demonstrate non-willfulness and minimize potential penalties.
