(Married Filing Separately)
(Personal Representative)

If Your Spouse Passed Away, How Should You File and Sign Your U.S. Tax Return?
Losing a spouse brings emotional difficulty, and on top of that, there are various administrative matters to handle — one of which is how to file and sign your tax return the following year. Many people aren't sure: "Can I still file a joint return if my spouse has passed away? And how should I fill out the signature section?" The IRS actually has clear rules on this. Here's a breakdown of the key points.
You can still file as "Married Filing Jointly"
- For the year your spouse passed away, as long as you haven't remarried, you as the surviving spouse can still file that entire year's return using the "Married Filing Jointly" status
- If you remarried before the end of the year in which your spouse passed away, you can no longer file a joint return on behalf of your deceased spouse — your deceased spouse's filing status instead becomes "Married Filing Separately"
Write "Deceased" in the name and address area
- Above the name and address line on the return, check the box labeled "Deceased"
- Also enter your spouse's date of death
How should you sign? It depends on whether a "Personal Representative" has been appointed
- If a personal representative (such as a court-appointed executor) has not been appointed: the surviving spouse signs the return and writes "filing as surviving spouse" in the signature area below the signature
- If a personal representative has been appointed: both the surviving spouse and the personal representative need to sign the return
Electronic filing is also available
- A deceased taxpayer's return can also be filed electronically (e-file)
- For the specific signature and notation requirements, follow the directions provided by your tax preparation software, as details may vary slightly between software programs
USCPA Luo Xia reminds you: the details involved in filing taxes after the loss of a spouse — including determining filing status, how to sign, and the "Deceased" notation — can easily lead to a return being rejected or delayed if even a small detail is missed. If your situation also involves estate filings, asset transfers, or other complex matters, it's recommended to consult a licensed, professional CPA to help you handle your tax filing correctly and with peace of mind during this difficult time in your life.
