Tax Pitfalls and Exemptions for Selling Foreign Real Estate as a U.S. Taxpayer

Under the strict rule of U.S. "global taxation," U.S. citizens and Green Card holders must report capital gains to the IRS when selling real estate anywhere in the world. Selling property and wiring funds without proper planning could result in a massive tax bill.

Here are three core tax highlights:

1. The Phantom Gain (Exchange Rate Trap) U.S. tax law requires that profits from the sale of property be calculated by converting the local currency to USD using the exchange rates on the exact days of purchase and sale. Suppose you bought a house in Taiwan years ago for 30 million NTD (about $909,000 USD at the time). This year, you sell it at the same price of 30 million NTD (now about $1,000,000 USD due to exchange rate fluctuations). Even though you made zero profit in Taiwan, in the eyes of the IRS, you generated a "phantom gain" of nearly $90,000 USD out of nowhere, which is subject to capital gains tax.

2. Can taxes paid in Taiwan offset U.S. taxes? Income taxes paid in Taiwan, such as the "House and Land Transactions Income Tax," can typically offset U.S. taxes through the Foreign Tax Credit (FTC). However, please note: Taiwan's unique "Land Value Increment Tax" is generally classified as a transaction or property tax under U.S. tax definitions. It cannot be used as a dollar-for-dollar tax credit; it can only be deducted as a cost of selling the property, which significantly reduces its tax-saving effect.

3. Primary Residence Exclusion (Section 121) This provision applies entirely to foreign real estate! If you are selling your primary residence, you can enjoy a tax exclusion of up to $250,000 USD for single filers, and up to $500,000 USD for married couples filing jointly.

  • Key Condition: Within the 5 years prior to the sale, you must have owned and lived in the property as your primary residence for a total of at least 2 years. Many new immigrants move to the U.S. and wait years before selling their old home in Taiwan. They often fail to meet the "2-year residency" requirement, losing their exclusion eligibility and ending up paying millions (in NTD) in unnecessary taxes.

USCPA Luo Xia reminds you:

Cross-border real estate transactions involve complex exchange rate calculations and differences between the tax systems of Taiwan and the U.S. Be sure to consult a U.S. Certified Public Accountant (CPA) who is familiar with international taxation and tax filing rules for U.S. expats. Verify your exclusion eligibility early and properly keep all receipts to ensure full compliance while maximizing your tax savings with peace of mind.
