2025 U.S. FBAR Penalty Adjustments

If you are a U.S. citizen, green card holder, or a U.S. resident alien and have foreign financial accounts (bank, securities, insurance, funds, etc.) located outside the United States, you are obligated to file an FBAR if at any point during the tax year the aggregate value of all your financial accounts exceeds $10,000.

If you are failure to file FBAR or filing it dishonestly, you may will face the Civil and Criminal Penalties. The penalty amounts for FBAR in 2025 have been partially adjusted due to inflation. Here are the latest civil and criminal penalties for 2025:

🔹 Non-Willful Violation

Civil Penalty:
Up to $16,536 for each negligent violation.

Criminal Penalty:
None.

Regulation:
31 U.S.C. § 5321(a)(5)(B)

🔹 Willfully Filing a False FBAR

Civil Penalty:
Up to $100,000 or 50% of the account balance, whichever is greater.

Criminal Penalty:

  • Up to $10,000 fine;
  • Up to 5 years imprisonment;
  • Or both.

Regulation:
18 U.S.C. § 1001; 31 C.F.R. § 103.59(d)

🔹 Willful Failure to File FBAR

Civil Penalty:
Up to $165,353 or 50% of the account balance, whichever is greater.

Criminal Penalty:

  • Up to $250,000 fine;
  • Up to 5 years imprisonment;
  • Or both.

Regulation:
31 U.S.C. § 5321(a)(5)(C); 31 U.S.C. § 5322(a); 31 C.F.R. § 103.59(b)

🔹 Willful Failure to File FBAR While Violating Other Laws

Civil Penalty:
Up to $100,000 or 50% of the account balance, whichever is greater.

Criminal Penalty:

  • Up to $500,000 fine;
  • Up to 10 years imprisonment;
  • Or both.

Regulation:
31 U.S.C. § 5322(b); 31 C.F.R. § 103.59(c)
